`Uloom al-Fiqh - Sciences of Jurisprudence

This course provides the student with an understanding of the sources of Islamic Law, the methodology of deriving rulings from it and comprehensively covers the rulings related to the pillars of Islam and all that they entail. In addition to this the rules and the role of economics and human rights in the Shariah will be taught.

This course has four components:

  1. Usool al-Fiqh – Principles of Jurisprudence

    Students will learn the sources of law and cover the methodology and principles developed by the jurists to derive rulings from the sources. In addition the students will attain an understanding of the relevance of the principles in the modern world.

    • al-Hukm Ash-Shar’i – A concise and modern text on the principles of Islamic law by Shaykh-ul-Islam Dr. Muhammad Tahir-ul-Qadri.
    • Ijtihad and Taqleed – A book on the derivation of rulings and following of authentic scholarship in sharia by Shaykh-ul-Islam Dr. Muhammad Tahir-ul-Qadri.
    • The Qur’anic Basis of Constitutional Theory – A text by Shaykh-ul-Islam Dr. Muhammad Tahir-ul-Qadri on constitutional theory in Islam as understood from the Qur’an.
    • Mithaq-e-Madina – By Shaykh-ul-Islam Dr. Muhammad Tahir-ul-Qadri.
    • Nass wa Tabir e Nass – By Shaykh-ul-Islam Dr. Muhammad Tahir-ul-Qadri.
    • Usool Ash Shashi – A classical text on the principles of Jurisprudence by Imaam Shaashi.
    • Usool al-Anwaar – An advanced classical text on the principles of Jurisprudence.
    • In addition to the above the student will be provided with DVDs of lectures by Shaykh-ul-Islam on Fiqh, Ijtihad and Taqleed.
  2. Fiqh - Jurisprudence

    Covers the legal rulings on the pillars of Islam including their evidences and inter-school of thought comparison. A curious student will learn to appreciate the differences of opinion amongst the schools.

    • al-Fiqhul Hanafi Wa Adillatuhu – A modern compilation of legal rulings based on a classical style by the great jurist of Damascus Shaykh As’ad Muhammad Sa’eed As-Sagharji.
    • Fiqh-ul-Qudoori – A classical text on Hanafi fiqh by Imaam Qudoori.
    • al-Hidayah – A comprehensive classical text on Hanafi fiqh by Imaam Burhan al-Din al-Marghinani al-Farghani.
  3. Iqtisadiyaat – Economics

    Covers the laws of buying and selling and also covers modern financial transactions in light of the shariah.

  4. Huqooq al-Insaani – Human Rights

    Covers the fiqh of human rights and the Islamic philosophy of human rights.
